Key points

  • DMD Costs’ statement of truth wording picker is a free online tool that gives the exact current statement of truth, or certificate, for a civil or family document and the person signing it, with the rule or practice direction paragraph it comes from and a copy button.
  • It is completely free, with no sign-up or paywall, and runs in your browser; nothing you choose is sent to DMD Costs.
  • Since 6 April 2020 the civil statement of truth has ended with the contempt sentence: “I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.” (PD 22 paras 2.1 and 2.2; PD 32 para 20.2, as amended by the 113th Practice Direction Update).
  • A statement of case, a witness statement, a Part 8 acknowledgment of service, a certificate of service and a contempt application must be verified by a statement of truth, and so must any other document where a rule or practice direction requires (CPR 22.1(1)); an application notice must be if the applicant wishes to rely on it as evidence (CPR 22.1(3)).
  • A legal representative may sign for the client, but the statement then refers to the client’s belief, not their own, and is signed in the representative’s own name with their capacity and firm (PD 22 paras 3.6 and 3.9). Where a party has a litigation friend, the statement in a statement of case or application notice is the litigation friend’s belief (CPR 22.1(5)).
  • An expert’s report and a costs budget have their own forms (PD 35 para 3.3; PD 22 para 2.3). A disclosure statement, the Precedent F certificates in a bill of costs and the certificate on Form N260 are not statements of truth and have their own words (CPR 31.10; PD 47 para 5.21; PD 44 para 9.5(3)).
  • In family proceedings the contempt sentence comes first: “I understand that proceedings for contempt of court … I believe that the facts stated in this [document] are true” (FPR PD 17A paras 2.1 and 2.2).

How to use the picker

  1. Choose the document. Pick the document being verified: a statement of case or application notice, a witness statement, an expert’s report, a certificate, a disclosure statement, a costs document, or a family document.
  2. Choose who signs. Pick the signer: the party, the legal representative, an officer of a company, the litigation friend, the witness or the expert. The wording changes with the signer.
  3. Fill in the details. Where the wording names the document or the party, choose them; say whether the statement of truth is in a separate document, or whether a witness statement is for a trial in the Business and Property Courts.
  4. Copy the wording. Copy the wording, read the points to check, and follow the source link to the paragraph it comes from.

Every wording, document by document

The wording for the first signer listed for each document. Choose another signer in the picker above: for a statement of case, the words change when a legal representative, an officer of a company or a litigation friend signs.

Frequently asked questions

Yes. It is completely free, with no sign-up, no paywall and no limit. It runs in your browser, and nothing you choose is sent to DMD Costs. It is a guide to the rules, not legal advice.
PD 22 para 2.1 gives it as: ‘[I believe][the (claimant or as may be) believes] that the facts stated in this [name document being verified] are true. [I understand] [The (claimant or as may be) understands] that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.’ The party signing personally uses “I believe” and “I understand”; a legal representative signing for the party refers to the party’s belief, as in “The claimant believes … The claimant understands …” (PD 22 para 3.6).
“I believe that the facts stated in this witness statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.” (PD 32 para 20.2; PD 22 para 2.2). It is signed by the witness (CPR 22.1(6)(b)), in the witness’s own language (PD 22 para 2.6), and dated with the date on which it is signed (PD 22 para 2.7).
On 6 April 2020, when the 113th Practice Direction Update added the sentence “I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.” to the statements of truth in PD 22 paras 2.1 and 2.2 and PD 32 para 20.2.
Yes, in a statement of case, an application or a notice of objections (CPR 22.1(6)(a)(ii)), but not in a witness statement, which the maker signs (CPR 22.1(6)(b)). The statement refers to the client’s belief, not the solicitor’s; the solicitor states the capacity in which they sign and the firm, signs in their own name and prints their full name beneath (PD 22 paras 3.6, 3.8 and 3.9). The signature is taken as the solicitor’s statement that the client authorised it and was told what it means and the possible consequences of a false statement (PD 22 para 3.7).
A person holding a senior position in the company, who must state the office or position held: for a registered company, a director, the treasurer, secretary, chief executive, manager or other officer (PD 22 paras 3.1 and 3.2). For a partnership, any partner or a person having the control or management of the partnership business may sign (PD 22 para 3.3).
No. A bill of costs is not among the documents CPR 22.1(1) or PD 22 para 1.1 requires to be verified by a statement of truth. It must contain the appropriate certificates from Precedent F (PD 47 para 5.21): the certificate as to accuracy and the certificate as to interest and payments are required in every case, signed by the receiving party or its solicitor.
No. It ends with a certificate: “The costs stated above do not exceed the costs which the [party] is liable to pay in respect of the work which this statement covers. Counsel’s fees and other expenses have been incurred in the amounts stated above and will be paid to the persons stated.” It must be signed by the party or the party’s legal representative (PD 44 para 9.5(3)).
Where that is for a reason other than language alone, the document must contain a certificate by an authorised person, someone able to administer oaths and take affidavits, that the document and the declaration of truth were read to the person, who appeared to understand them and signed or made their mark in the authorised person’s presence (CPR 22.1(9)). PD 22 para 2.4 gives the form.
